Puzzled Escape Rooms Waiver
In exchange for participation in the Puzzle Room Event organized by Kask LLC DBA Puzzled Escape Rooms, of 606 1st Ave N, Suite 300, Fargo, North Dakota, 58102 and/or use of the property, facilities, and services of Puzzled Escape Rooms, I agree for myself and (if applicable) for the members of my family, to the following:
1. I understand that Puzzled Escape Rooms reserves the right to refuse entry to the Puzzled Escape Rooms facility if the employees or staff believe that the participants could create a risk of harm to themselves or other participants. This includes, but is not limited to, if the participants appear to be under the influence of alcohol or drugs.
2. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Puzzled Escape Rooms, or the employees, representatives or agents of Puzzled Escape Rooms.
3. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Puzzled Escape Rooms for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Puzzled Escape Rooms, whether caused by the fault of myself, my family, Puzzled Escape Rooms or other third parties.
4. I agree to indemnify and defend Puzzled Escape Rooms against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Puzzled Escape Rooms.
5. I agree to pay for all damages to the facilities of Puzzled Escape Rooms caused by me or my family's negligent, reckless, or willful actions.
6. Any legal claim that may arise from participation in the above shall be resolved under Minnesota law.
7. I further grant Puzzled Escape Rooms the right to photograph, videotape, and/or record me or my family and to use my or my family's name, face, likeness, voice and appearance in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation.
8. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY AND A WAIVER OF ANY RIGHT THAT I MAY HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST PUZZLED ESCAPE ROOMS. SHOULD ANY CLAIM BE MADE, I UNDERSTAND AND AGREE THAT I WILL BE RESPONSIBLE FOR ALL ATTORNEYS FEES AND DEFENSE COSTS INCURRED BY PUZZLED ESCAPE ROOMS IN CONNECTION WITH OR IN THE DEFENSE OF THAT CLAIM.
